Mississippi mechanics lienDeadlines and how to file

The Mississippi lien rules below each cite the statute they come from.

How many days do you have to file a mechanics lien in Mississippi?

File the claim of lien with the chancery clerk of the county where the property is located within 90 days after your last work, labor, services or materials. The lien must carry the statutory warning that it expires and is void 180 days after filing unless a payment action is filed, and a notice that the owner may contest it; leaving these out invalidates the lien. Within 2 business days after filing, send a copy by registered or certified mail or statutory overnight delivery to the owner (or the contractor as the owner's agent), and, if you are not the contractor, to the contractor too. No lien exists for an unlicensed contractor or subcontractor.1 Miss. Code 85-7-405(1)(b); 85-7-403(5)

Do you need a preliminary notice in Mississippi?

A subcontractor or supplier who has no direct contract with the contractor must send a written notice to the contractor (or to the owner if there is no contractor) within 30 days after first delivering labor, services or materials, by e-mail with confirmed receipt, registered or certified mail, or statutory overnight delivery. Skipping the notice forfeits the lien. This notice rule does not apply to single-family residential construction. On single-family homes, a claimant not in privity with the owner must instead give the owner a written pre-lien notice at least 10 days before filing the lien.1 Miss. Code 85-7-407(2), (4); 85-7-409(2)

How long is a mechanics lien good for in Mississippi?

File a payment action (suit against the party you contracted with, with a lis pendens) within 180 days after the lien was filed, or the lien is unenforceable. If the owner or contractor records a notice of contest, the lien is extinguished 90 days after that notice is filed unless suit has been filed.1 Miss. Code 85-7-405(1)(c); 85-7-421(1); 85-7-423(3)

Who can file a mechanics lien in Mississippi?

Contractors, subcontractors and materialmen, registered architects and professional engineers, and registered land surveyors have a special lien on the real estate they improve or serve, limited to the amount due under their contract. A contractor or subcontractor must hold the required Mississippi contractor license.1 Miss. Code 85-7-403(1), (3), (5)
