How many days do you have to file a mechanics lien in Oregon?

Perfect by filing a verified claim of lien with the county recording officer within 75 days after the claimant stopped providing labor, equipment or materials, or 75 days after completion of construction, whichever is earlier (for lien claims under ORS 87.010(1)-(2)); other claimants within 75 days after completion. When is the Oregon notice of right to a lien due?

Anyone furnishing labor, materials, equipment or services other than at the owner's own request must give the owner a notice of right to a lien. It can be given at any time but only protects work provided from 8 days (excluding Saturdays, Sundays and holidays) before the notice is delivered or mailed. Those working on or supplying a commercial improvement (anything but a residence of four or fewer units occupied by the owner) need not give it. Separately, a notice of intent to foreclose goes to the owner and mortgagee at least 10 days before suit.1 ORS 87.021(1), (3); ORS 87.057(1)

How long is a mechanics lien good for in Oregon?

The lien lapses 120 days after the claim of lien is filed unless suit is brought; if the claim states extended payment terms, 120 days after the extended payment date, but never longer than two years from filing.1 ORS 87.055

Who can file a mechanics lien in Oregon?

Anyone who performs labor, transports or furnishes material, or rents equipment for an improvement at the request of the owner or the owner's construction agent; also land preparation contractors, employee benefit plan trustees, and design professionals (architects, surveyors, engineers). Equipment rental liens are limited to reasonable rental value.1 ORS 87.010(1)-(5)

Does an Oregon lien claim have to be notarized?

The claim of lien must be verified by the oath of the filer or another person with knowledge of the facts, subject to false swearing penalties; the text read does not require a notary acknowledgment.1 ORS 87.035(4)
