How many days do you have to file a mechanics lien in Alaska?
Record a verified claim of lien with the district recorder no later than 120 days after completing the contract or ceasing to furnish labor, materials, services or equipment. If the owner records a notice of completion, a claimant who gave no notice of right to lien, or who got advance notice of the recording date, has only 15 days after that recording to record a claim of lien or a notice of right to lien.1 AS 34.35.068; AS 34.35.070
Do you need a preliminary notice in Alaska?
A notice of right to lien is optional but strongly protective: if a claimant gives the owner the written notice before furnishing labor or materials, the owner has the burden of proving they did not know of or consent to the work; without it, the claimant must prove the owner knew and consented. The notice must carry a statutory warning and the claimant's details, and the claimant must disclose the amount due within five days when the owner, lender or prime contractor asks.1 AS 34.35.064
How long is a mechanics lien good for in Alaska?
The lien stops binding the property six months after the claim is recorded unless a suit to enforce it is started in the superior court within that time (or six months after an extension notice is recorded within the original six months).1 AS 34.35.080; AS 34.35.110
Who can file a mechanics lien in Alaska?
A person has a lien to secure the contract price if they perform labor on real property at the owner's or the owner's agent's request, or deliver materials or equipment under a contract with the owner or the owner's agent that are used in the construction, alteration or repair of a building or improvement. Trustees of employee benefit trusts can also claim one.1 AS 34.35.050
Does an Alaska lien claim have to be notarized?
The claim of lien must be verified by the oath of the claimant or another person who has knowledge of the facts.1 AS 34.35.070(c)
What about public jobs in Alaska?
Before a public building or public works contract over $100,000 is awarded, the contractor must furnish a performance bond and a payment bond with a qualified surety. The payment bond protects everyone who supplies labor and material and is set at one-half of the contract amount for contracts up to $1,000,000, with smaller percentages for larger contracts.2 AS 36.25.010
